Today, we're going to talk about what to do when your tenants won't leave. It's a tricky situation, but we've got some tips that can help you navigate through it. 

First and foremost, it's important to know your rights and the laws surrounding eviction in New South Wales. 

The Residential Tenancies Act outlines the process for ending a tenancy, including the grounds for eviction and the steps you need to take to give notice to your tenant. Make sure to review these laws and regulations carefully, and seek legal advice if you need to. If your tenant is simply refusing to leave after their lease has expired, you can serve them with a termination notice. This notice must be in writing and give the tenant a specific amount of time to vacate the property. If they still refuse to leave after this time has passed, you can apply to the NSW Civil and Administrative Tribunal (NCAT) for a possession order. It's important to note that you can't use force or change the locks on the property to try and evict your tenant. This is illegal and could result in serious consequences for you. Another option is to try and negotiate with your tenant. Sometimes, there may be an underlying issue that's causing them to stay longer than anticipated. By having an open and honest conversation, you may be able to come to a mutually beneficial solution. Dealing with a tenant who won't leave can be stressful and time-consuming, but it's important to stay calm and follow the proper legal procedures. Remember to review the laws and regulations surrounding eviction in New South Wales, and seek legal advice if you need it.
